Accident Waiver & Release of Liability

The Participant acknowledges that participation in D³ Media productions, events, and activities — including but not limited to on-camera appearances, live performances, cooking competitions, physical challenges, travel to and from filming locations, and any other activities associated with D³ Media programming — involves inherent risks, dangers, and hazards.

These risks include, but are not limited to: physical injury, illness, property damage, accidents, equipment malfunction, exposure to allergens or hazardous materials, and other unforeseen circumstances. The Participant voluntarily assumes all such risks, known and unknown, associated with participation.

In consideration of being permitted to participate in any D³ Media activity, the Participant, on behalf of themselves and their heirs, executors, administrators, legal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue D³ Media Network, LLC, its officers, directors, employees, agents, contractors, volunteers, sponsors, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the Participant while participating in any D³ Media activity.

This release applies to any claims arising from the negligence of the Released Parties, to the fullest extent permitted by applicable law.

The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Participant's participation in any D³ Media activity; (b) any breach of this Waiver by the Participant; or (c) any act or omission of the Participant that causes injury or damage to any person or property.

In the event of an accident, injury, or medical emergency during any D³ Media activity, the Participant authorizes D³ Media and its representatives to seek and obtain emergency medical treatment on the Participant's behalf. The Participant agrees to be solely responsible for all costs associated with such medical treatment, including but not limited to emergency services, hospitalization, and follow-up care.

The Participant represents that they are in good physical health and are not aware of any medical condition that would prevent safe participation in D³ Media activities. Participants with known medical conditions are encouraged to consult a physician before participating.

D³ Media is not responsible for the loss, theft, or damage of any personal property brought to or used during any D³ Media production, event, or activity. The Participant assumes full responsibility for their personal belongings at all times.

The Participant agrees to follow all safety instructions, guidelines, and directives issued by D³ Media staff, production crew, and venue personnel. Failure to comply with safety instructions may result in immediate removal from the activity without compensation or recourse.

The Participant agrees to conduct themselves in a professional and respectful manner at all times and to refrain from any behavior that endangers themselves or others.

The Participant grants D³ Media Network, LLC the right to photograph, film, record, and otherwise capture the Participant's likeness, voice, and performance during any D³ Media activity. D³ Media may use such materials for any purpose related to its productions, marketing, promotional materials, or broadcasts, without additional compensation to the Participant unless otherwise agreed in a separate written agreement.

If any provision of this Waiver is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Waiver shall continue in full force and effect.

This Waiver shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under this Waiver shall be resolved exclusively in the state or federal courts located in Texas.

The Participant acknowledges that they have read this Waiver in its entirety, understand its terms, and agree to be bound by it. The Participant further acknowledges that this Waiver is intended to be as broad and inclusive as permitted by applicable law, and that if any portion is held invalid, the remainder of the Waiver shall continue in full legal force and effect.

By participating in any D³ Media activity — whether by signing a physical copy, submitting an online application, or otherwise engaging in a D³ Media production or event — the Participant agrees to be bound by the terms of this Waiver.
