The health information disclaimer and medical advice exclusion sections are particularly important and should be reviewed by counsel familiar with health app regulations.These Terms of Service ("Terms") govern your use of the myBreastie application ("App") provided by D³. By using the App, you agree to these Terms.
1. About myBreastie
myBreastie is a health and wellness companion application designed to support individuals navigating breast health, breast cancer awareness, and related wellness journeys. The App provides information, community support, and wellness tracking tools.
2. Not Medical Advice
IMPORTANT: myBreastie is not a medical device and does not provide medical advice, diagnosis, or treatment. The information provided through the App is for informational and wellness purposes only. Always consult a qualified healthcare provider for medical advice, diagnosis, and treatment. Do not delay seeking medical care based on information from the App.
3. Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent that you are at least 18 years old.
4. Health Information
The App may allow you to track and store health information. You acknowledge that you are responsible for the accuracy of health information you enter, D³ is not a healthcare provider and does not review or validate your health information, health information you enter is stored in accordance with the D³ Privacy Notice, and you should share App data with your healthcare provider at your discretion.
5. Community Features
The App may include community features. You agree to treat all community members with respect and compassion, not share others' personal health information without their consent, not provide medical advice to other users, and comply with D³ Community Guidelines.
6. Limitation of Liability
D³'s liability to you for any claims arising from your use of the App is limited to $100. D³ is not liable for any indirect, incidental, consequential, or punitive damages. D³ is not liable for any health outcomes arising from your use of the App.
7. Governing Law
These Terms are governed by the laws of the State of Texas.
