Volunteer & Production Assistant Release

This Volunteer and Production Assistant Release ("Release") governs the participation of volunteers and production assistants ("Volunteer") in D³ productions. By volunteering or serving as a production assistant, Volunteer agrees to this Release.

1. Nature of Participation

Volunteer's participation is voluntary and uncompensated unless a separate written agreement specifies compensation. Volunteer is not an employee of D³ and is not entitled to any employment benefits. Volunteer's participation does not create an employment relationship.

2. Duties

Volunteer agrees to perform assigned duties under the direction of D³ production staff, follow all D³ production protocols and safety guidelines, treat all participants, crew, and D³ personnel professionally and respectfully, maintain confidentiality of all Production information, and not perform duties beyond those assigned without authorization.

3. Consent to Recording

Volunteer consents to being incidentally recorded during Production activities. D³ may use footage in which Volunteer appears incidentally in connection with the Production.

4. Assumption of Risk

Volunteer acknowledges that Production activities may involve physical activity, equipment operation, and other activities that carry inherent risk. Volunteer voluntarily assumes these risks.

5. Release of Claims

Volunteer releases D³ from any and all claims arising from Volunteer's participation in Production activities, including claims arising from injury, property damage, or other harm, except claims arising from D³'s gross negligence or intentional misconduct.

6. Confidentiality

Volunteer agrees to keep confidential all non-public information about the Production, participants, and D³ operations. This obligation continues for 2 years after Volunteer's participation ends.

7. Intellectual Property

Any work product created by Volunteer in connection with the Production is a work made for hire owned by D³. To the extent any work product is not a work made for hire, Volunteer assigns all rights in such work product to D³.

8. Governing Law

This Release is governed by the laws of the State of Texas.
